Terms and conditions of trade for Aston Precision Pty Ltd.
Aston Precision Pty Ltd hereinafter referred to as Aston Precision.
Cash payment in full upfront, or the percentage agreed in writing with a sales representative, with the remainder on job completion — unless the customer has an approved payment term in place with a relevant credit account, in which case payment is strictly within thirty (30) days from the date the invoice was raised.
If payment is not received, the customer will pay Aston Precision's reasonable costs incurred in recovering any overdue amount. Aston Precision reserves the right to charge interest at 4% above the Penalty Interest Rates Act (Vic) rate on overdue accounts.
All prices are as quoted to the customer by formal written quote.
Aston Precision's liability ceases upon release of goods to authorised third-party carriers. To the fullest extent permissible at law, Aston Precision limits its liability to either re-supplying the goods and services, or meeting the costs of having them supplied again. Aston Precision will not be liable for loss of profit, consequential loss, or any other indirect or contingent loss.
Until full payment is received, title and ownership of goods shall remain with Aston Precision. If the customer defaults in payment, Aston Precision may retake possession of any goods for which full payment has not been received. The customer agrees that Aston Precision may enter upon any premises occupied by the customer for the purpose of inspecting or retaking possession of its goods.
Delivery will be made in accordance with the quotation. The customer will be deemed to have accepted goods unless it notifies Aston Precision to the contrary within 5 business days of the delivery date.
In respect of defective or non-compliant goods, the customer must notify Aston Precision within 5 business days of delivery. Aston Precision will then arrange an inspection and determine the appropriate course of action.
The customer charges and grants a security interest to Aston Precision over all present and future rights in goods sold by Aston Precision and any proceeds as defined in the Personal Property Security Act 2009 (Cth). The customer shall do all things reasonably required to enable Aston Precision to register its security interests.
If any provision of these terms is not enforceable, other provisions which are self-sustaining remain effective. The law and jurisdiction of Victoria apply to any order placed with and accepted by Aston Precision.
